After a few years, the FDA declared CBD products for dogs to be illegal, alleging they were not medicines.
Is potency the real issue?
Another significant difference—and one that might bode difficulty for the Delta-8 THC industry—is that, although CBD does not cause intoxication, Delta-8 products can.
According to Battles, who didn't want to hear the same complaints from disgruntled (and un-stoned) consumers who weren't getting their money's worth, Vance Global released a Delta-8 THC edibles line last month that is "as extremely strong as possible."
"Half a gummy will get you incredibly high," he claimed. As a result, Battles wasn't surprised when the CDC and FDA said they were keeping an eye on things. "I had a feeling it was going to happen," she adds.
No one has detected any changes in vendor, distributor, or customer attitudes as a result of the FDA/CDC warnings, according to the Delta-8 vendors and distributors contacted for this report. They did so, however, while deducing a different conclusion from the federal agencies' warning.

Some Delta-8 THC growers want their industry to be controlled. ATLRx, an Atlanta-based firm that distributes and advertises Delta-8 THC and CBD products online and in physical stores around Georgia, is co-founded by Chase Slappey.
Unlike those spotted in truck stops and unsavoury neighbourhoods, such as the ones the CDC and FDA cautioned about on Tuesday, ATLRx items are "clinically examined and have unique QR codes that offer 'full panel' lab findings," according to Dr. Granade.
"You'll stress out if you eat too much, especially if you don't have a tolerance for it." He went on to say, "That'll simply happen organically." “However, there are a lot of bad actors out there that aren't creating Delta-8 the right way.”
For the time being, the Delta-8 market remains flat. In fact, the FDA may have unwittingly increased consumer interest and attention.
When a tightening campaign begins, Friesen believes the FDA will begin by issuing cease-and-desist orders to a few Delta-8 enterprises, starting with the most significant or abusive, in a similar manner to how the CBD sector was shut down by the FDA.
"With Delta-8 items, we'll see the same cycle," she said. It's possible that a Farm Bill amendment may be introduced to clarify which hemp derivatives are lawful, which aren't, and which require government regulation.
Finally, there's the issue of federal cannabis legalisation, which loomed huge in the background. If marijuana with Delta-9 THC becomes legal, demand for Delta-8 THC, a synthetic substance manufactured to fill the void left by drug prohibition, would vanish. Delta-8 will be rendered obsolete if federal marijuana legislation succeeds.
